Jan contacted us upon receiving a demand from a workers’ compensation insurer.

Jan had previously contacted another insurer to ascertain whether she would be covered for any injury to this “worker” and was told by the insurer’s call staff that she would be.

Our Approach

We recognised the representation to Jan by her insurer was misleading and deceptive.

To assist Jan we:

  • Challenged the decision of the workers’ compensation insurer to accept the original claim.
  • Obtained the transcript of Jan’s discussion with her insurer, wherein she was advised that she would be covered.
  • Submitted an internal review to her insurer.
  • Submitted a complaint to the Australian Financial Complaints Authority.
Outcome

Jan’s insurer agreed to indemnify her for any liability to the workers’ compensation insurer and reimburse her for all legal costs that she incurred with us.
